Welcome to The RiperYears website (“Site”). This Site is provided by The Principle Foundation (“TPF” or “we” or “our”) for use as an information resource center for senior Christian Scientists and their family and friends (who may not all identify as Christian Scientists) (“user” or “you” or “your”).

PLEASE READ THESE TERMS OF SERVICE CAREFULLY.

Acceptance of Terms of Service

By using our Site, you accept and agree to be bound by these Terms of Service (“TOS”) and our Privacy Policy which is incorporated into these TOS and which can be accessed here. These TOS constitute a legally binding contract between you and TPF. We may change these TOS or the Privacy Policy at any time, and such changes will be posted on this or a similar page of the Site. We recommend periodically reviewing these TOS and the Privacy Policy when you use the Site to make sure you are aware of the most recent versions. By continuing to use the Site, you consent to any changes to these TOS and/or the Privacy Policy. PLEASE DO NOT USE THE SITE IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE OR THE PRIVACY POLICY.

All Materials displayed on our Site are protected by United States and international copyright, trademark, and other intellectual property laws. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute any Materials from this Site, including code and software underlying this Site. You may download Materials for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices. Any unauthorized use of Materials is a breach of these TOS for which we may suspend or terminate your rights to use the Site.

Modifications to Site; Termination and Suspension

We reserve the right at any time and in our sole discretion, to modify, alter, suspend, and or discontinue, temporarily or permanently, this Site, links to Third-Party Sites (as herein defined), and/or any Materials or services offered on or through this Site. We may cancel, suspend, or terminate your right to use the Site at any time with or without notice in our sole discretion. In the event of suspension or termination, we reserve the right to block your access to the Site. The restrictions imposed on you with respect to Materials downloaded from the Site, and the disclaimers and limitations of liabilities set forth in these TOS shall survive termination. You hereby release TPF from any and all damages and liability of any kind arising from or related to our exercise of our rights under this section.

Once you have left our Site we have no control over the content and materials that you will be viewing on the Third-Party Site. We are not responsible for the content, accuracy, or opinions expressed on any Third-Party Site. NO ADVICE AND/OR INFORMATION, DESPITE WHETHER WRITTEN OR ORAL, THAT MAY BE OBTAINED BY YOU FROM TPF, THE CARING FOR CHRISTIAN SCIENTISTS CALL CENTER, OR FROM OUR SITE, ANY THIRD-PARTY SITE, OR ANY MATERIALS SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS. OUR SITE AND MATERIALS ARE NOT INTENDED TO CONSTITUTE OR BE USED FOR LEGAL, HEALTH, OR FINANCIAL ADVICE.

IF YOU ARE DISSATISFIED WITH THE SITE, THE SITE MATERIALS, OR THESE TOS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Indemnity

You agree to indemnify, defend, and hold harmless TPF, our affiliates, and our respective directors and officers from and against any and all injuries, damages, losses, liabilities, claims, judgments, and settlements, including all reasonable costs, expenses, and attorneys’ fees arising from or related to any breach by you of these TOS or applicable law, your negligent or willful act or omission while using the Site, or your infringement of any third party’s intellectual property rights, ownership rights, or privacy rights.

Personal Liability

No director, officer, employee, or agent of TPF or its affiliates shall be personally liable to you or to any third party for any damages of any kind whatsoever arising from or relating to the Site or these TOS.

Submitted Contributions

Our site may allow you to submit your ideas, documents, suggestions, feedback, and/or proposals (“Contributions”) about our Site. If you submit Contributions, you acknowledge and agree that:

1. your Contributions do not contain any type of confidential or proprietary information
2. TPF shall not be liable or under any obligation to ensure or maintain confidentiality, expressed or implied, related to any Contributions
3. TPF may use, display, incorporate in other works, make derivatives from, and/or disclose any and all Contributions in any such manner as it sees fit in its sole and absolute discretion
4. your Contributions automatically become the sole and exclusive property of TPF upon our receipt of the Contributions and you hereby assign all of your right, title, and interest in and to your Contributions
5. you have all necessary rights to submit your Contributions and to assign ownership in the Contributions to TPF and such submission, assignment, and use by TPF of your Contributions will not infringe any third party’s ownership rights, privacy rights, or intellectual property rights
6. TPF is under no obligation to compensate or reimburse you for your Contributions, and you are submitting your Contributions free of any cost, fees, or consideration of any kind

Entire Agreement

These TOS and the Privacy Policy constitute the entire agreement between us and you with respect to your use of the Site and Materials, and these documents supersede all previous and contemporaneous agreements, proposals and communications, written or oral with respect to this subject matter.

Governing Law

These TOS are governed by the laws of the State of Missouri, without regard to choice of law principles.

No Waiver

No delay or failure by TPF to enforce these TOS shall constitute a waiver of any of our rights hereunder, and only a specific, written waiver signed by an authorized representative of TPF shall have any legal effect.

Severability

If any clause or provision set forth in these TOS is determined to be illegal, invalid, or unenforceable under present or future law, the clause or provision shall be deemed to be deleted without affecting the enforceability of all remaining clauses or provisions.

Copyright or Intellectual Property Infringement Claims Notice & Procedures

TPF will always respect the intellectual property of others, and we ask that all of our users do the same. If you feel that your work has been duplicated in such a way that would constitute copyright infringement, or if you believe your intellectual property rights have been otherwise violated, please provide to us the following information:

1. The electronic or the physical signature of the individual that is authorized on behalf of the owner of the copyright or other intellectual property interest
2. A description of the copyrighted work or other intellectual property that you believe has been infringed upon
3. A description of the location of the site which you allege has been infringing upon your work
4. The physical address, telephone number, and email address of the individual claiming ownership of the intellectual property
5. A statement, in which you state that the alleged and disputed use of your work is not authorized by the copyright owner, its agents, or the law
6. And finally, a statement, made under penalty of perjury, that the aforementioned information in your notice is the truth and accurate, and that you are the copyright or intellectual property owner, representative or agent authorized to act on the copyright or intellectual property owner’s behalf
